ORDINANCE AUTHORIZING AND DIRECTING THE SERVICE DIRECTOR TO ENTER INTO CONTRACT WITH HIGH TOUCH HOMES FOR THE SENATE ST. SIDEWALK PROJECT AND DECLARING AN EMERGENCY

WHEREAS, Ordinance No. 2009 - 51 authorized applying and administering the FY 2009 CDBG Formula Grant which includes replacing sidewalk on Senate St.

WHEREAS, Eight (8) bids were received ranging from $32,999 to $49,588.66, and

WHEREAS, High Touch Homes was the lowest and best bidder, and

WHEREAS, the FY 2009 Formula grant has $50,000 budgeted for this sidewalk activity.

BE IT ORDAINED by the Council of the City of Marion, Marion County, Ohio:

Section 1. That the Service Director be directed to enter into contract with High Touch Homes, Lexington OH in the amount of $32,999 for the Senate St. Sidewalk Project.

Section 2. That said contract shall be payable up to $50,000 from the Community Development Block Grant FY 2009 Formula Program

Section 3. The FY 09 Formula Grant requires that all work be completed by June 30, 2011

Section 4. This ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, welfare and safety of the City of Marion and the inhabitants thereof and for the further reason that the construction must be finished and inspected by June 30, 2011, provided it receives the affirmative vote of two-thirds of all members elected to Council; it shall become effective from and after the earliest period allowed by law.
