ORDINANCE AUTHORIZING THE MARION AREA COMMUNITY IMPROVEMENT CORPORATION (CIC) TO ACT ON BEHALF OF THE CITY OF MARION TO EXECUTE AND EFFECTUATE THE SALE OF REAL PROPERTY TO PIZZUTI WP MARION LLC ASSOCIATED WITH THE WHIRLPOOL EXPANSION AND DECLARING AN EMERGENCY
WHEREAS, the Council and Administration has been supportive of local industry and the facilitation of job market enhancement, and
WHEREAS, Council enabled the current expansion of the Whirlpool production facility by passage of 2010-104 Ordinance leasing a certain City owned strip of land adjacent to the new warehouse facility, and
WHERAS, working closely with the project developer the Council now finds it necessary to transfer the subject strip of land to the project site owner, said strip being not otherwise required for City purposes, and the transfer of same would benefit and promote the industrial and economic welfare of the City and provide enhanced employment opportunities for citizens of the community,
BE IT ORDAINED by the Council of the City of Marion, Marion County, Ohio:
Section 1. The Council, having previously designated the Marion Area Community Improvement Corporation (CIC) an agent of the City under the statutes of the State of Ohio for economic development, does hereby find the real property as depicted in the Exhibit attached hereto is no longer necessary for any City purpose and that the real property contained upon Exhibit A attached hereto and made a part hereof should be transferred to Pizzuti WP Marion LLC or its designee through the City's agent the CIC. Council hereby determining said transfer of title is necessary to promote the industrial and economic welfare of the City and community does hereby authorize the Mayor to complete all actions necessary to effectuate the transfer of title.
Section 2. That this ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, welfare and safety of the City of Marion and the inhabitants thereof, and due to immediate need to transfer title without delay to enhance economic development and not cause any delay with the industrial expansion, and as such, shall take effect and be in force immediately upon its passage and approval by the Mayor, provided it receives the affirmative vote of two-thirds of all members elected to Council; otherwise it shall become effective from and after the earliest period allowed by law.
