ORDINANCE AUTHORIZING THE SAFETY DIRECTOR TO ENTER INTO CONTRACT WITH STUDER-OBRINGER AND ASTRO POOL COMPANY FOR THE NEW AQUATICS CENTER HAVING DETERMINED SAID ENTITIES TO HAVE SUBMITTED THE LOWEST AND BEST BID AND DECLARING AN EMERGENCY
WHEREAS, Council by previous Ordinance 2010-77 authorized the Aquatic Center project be placed out for bid, and
WHEREAS, the professional design firm and City Administrators after receiving the bid submittals conducted in depth analysis and determined the lowest and best bids as provided below,
BE IT ORDAINED by the Council of the City of Marion, Marion County, Ohio
Section 1. The Council having received the recommendation of the professional design firm and the City Administrators as to the lowest and best bidders in the recent Aquatics Center letting, and the Council herein determining after due consideration and deliberation that Studer-Obringer from New Washington, Ohio had the lowest and best bid of 1,633,000 for the general trade portion, and Astro Pool Company from Mansfield, Ohio had the lowest and best bid of 1,588,900 for the swimming pool bid. A combined bid of 3,200,000. Council hereby authorizes and directs the Safety Director to enter into contract with Studer-Obringer and Astro Pool Company.
Section 2. That the contract shall be payable from the Capital Improvements Fund 401.4008.
Section 3. That this ordinance is hereby declared to be an emergency measure necessary for the welfare of the City of Marion and the inhabitants thereof, and shall take effect and be in force immediately upon its passage and approval by the Mayor given the immediate need to start the site preparation without a delay so the 2011 pool season be interrupted as little as possible; provided it receives the affirmative vote of two thirds of all members elected to Council, otherwise, it shall become effective from and after the earliest period allowed by law.
